The Oneida Daily Dispatch, LEGAL NOTICE PUBLIC NOTICE VILLAGE OF HAMILTON TOWN OF HAMILTON NOTICE IS HEREBY GIVEN, pursuant to General Municipal Law § 704, that a petition by Colgate University for the annexation of certain territory in the Town of Hamilton to the Village of Hamilton has been received by the Town Board of the Town of Hamilton, and the Board of Trustees of the Village of Hamilton, being the village to which it is proposed to annex the territory described as approximately 5.297+ acres of uninhabited lands owned entirely by Colgate University adjoining the southerly boundary of the Village of Hamilton and located along the westerly side of Broad Street (Route 12B), known as tax map parcel #’s: 168.-1-21,168.-1-18.1, 168.-1-18 and a portion of 168.1-22, as more fully described in the attached Schedule “A”. On July 27 at 7:00 p.m.at the Court House, 60 Montgomery Street, Hamilton, New York, a joint public hearing will be held on the petition by the Town Board of the Town of Hamilton and the Board of Trustees of the Village of Hamilton. The members of the above governing boards of the Town of Hamilton and Village of Hamilton will meet at the above time and place to hear any testimony and receive evidence and information which may be presented concerning the petition and the question of whether the annexation is in the overall public interest, including but not limited to testimony, evidence and information concerning the following: a) That a person signing the petition is not qualified therefore, or b) That the persons signing such petition do not represent the owners of a majority in assessed valuation of the property within such territory assessed upon the last proceeding town assessment roll, or c) That the petition does not otherwise substantially comply in form or content with the provisions of Article 17 of the General Municipal Law of the State of New York, or d) That the proposed annexation is or is not in the over-all public interest (1) of the territory proposed to be annexed, or (2) of the local government or governments to which the territory is proposed to be annexed, or (3) of the remaining area of the local government or governments in which such territory is situated, or (4) of any school district, fire district or other district corporation, public benefit corporation, fire protection district, fire alarm district or town or county improvement district; situated wholly or partly in the territory proposed to be annexed. Objections based upon subparagraphs a, b or c above, in addition to the presentation of oral testimony thereon, must be submitted in writing and placed on file with the Boards holding the hearing and made a part of the record thereof. Burton Marshall (Now or Formerly), as described in a Warranty Deed dated December 12, 2007 and filed in the Madison County Clerk’s Office in Liber 1427 of Deeds at Page 263; thence N47°27’04”W 424.74 feet along the northeasterly boundary of M. Burton Marshall to an iron rod standing at the northeasterly corner of M. Burton Marshall and on the nominal centerline of the former Chenango Canal; thence N44°09’48”E 571.95 feet along the nominal centerline of the former Chenango Canal to an iron rod standing on the southwesterly boundary of other lands of Colgate University (Now or Formerly); thence S50°34’00” 368.69 feet along the southwesterly boundary of other lands of Colgate University to a point standing on the nominal centerline of New York State Route 12B; thence S38°38’08”W 593.14 feet along the nominal centerline of New York State Route 12B to the point and place of beginning. The above described parcel containing 5.297 acres of land, more or less.
