The Oneida Daily Dispatch, LEGAL NOTICE At a Term of the Supreme Court of the State of New York, held in and for the County of Madison at Wampsville, New York, on the 27th day of November, 2013. PRESENT: Donald F. Cerio, Jr. A/Supreme Court Justice STATE OF NEW YORK SUPREME COURT COUNTY OF MADISON In the Matter of the Application of GAYNELL DORRANCE, in her capacity as a Director and as President of the Board of Directors Of MADISON COUNTY 4-H FOUNDATION, INC., ORDER TO SHOW CAUSE Index No. 13-1865 Petitioner, for the Judicial Dissolution of the MADISON COUNTY 4-H FOUNDATION, INC. Upon reading and filing the Verified Petition of Gaynell Dorrance, in her capacity as a Director and as President of the Board of Directors of Madison County 4-H Foundation, Inc., duly verified on the 13th day of November, 2013; that Madison County 4-H Foundation, Inc. is a not-for-profit corporation organized under and existing by virtue of the laws of the State of New York; that a dissolution will be beneficial to the members and that the Corporation is no longer able to carry out its purposes, Let Madison County 4-H Foundation, Inc., the Attorney General of the State of New York, the New York State Tax Department, whose consent or approval may or may not be required by Not-For-Profit Corporation Law §909, any members, creditors or any other claimants or persons as may be interested, SHOW CAUSE at a term of this Court to be held at the Madison County Courthouse, North Court Street, Wampsville, New York, on the 21st day of February, 2014, at 9:30 o’clock in the fore noon of that day, or as soon thereafter as counsel can be heard, why an Order should not be entered judicially dissolving Madison County 4-H Foundation, Inc. pursuant to New York Not-For-Profit Law §1102(a)(1) and §1102(a)(2)(E), together with such other and further relief as this Court deems just and proper; and it is further ORDERED, that a copy of this Order to Show Cause shall be made by publication at least once in each of the three (3) weeks prior to the return date herein, in the Oneida Daily Dispatch a newspaper published in the County of Madison and State of New York, hereby designed as being most likely to give notice to any members, creditors or any other claimants or persons as may be interested; and it is further ORDERED, that service of a copy of this Order together with the papers upon which it is granted upon Madison County 4-H Foundation, Inc., the Attorney General of the State of New York, the New York State Tax Department, personally on or before the 20th day of December, 2013, or by certified mail, on or before the 13th day of December, 2013, be deemed sufficient service; and it is further ORDERED, that service of a copy of this Order together with a Notice of where the papers upon which it is granted can be obtained be served by regular mail upon all the individuals and entities attached to the Verified Petition as Exhibit “B”; and it is further ORDERED, that any responsive papers are hereby directed to be filed with the Court and copied to Petitioner’s counsel no later than February 3, 2014.
